A contract can be an oral one or a written one. In case of an oral contract, the terms of the contract are exchanged in verbal manner. In the written contract, on the other hand, the terms of the contract are stated down on a document and signed by the parties to the contract[2]. In order to form a valid contract, it needs to have certain essential elements[3]. These include, an offer, an acceptance, consideration, intent, capacity and clarity regarding the terms of the contract[4]. An offer has to be made by one party, which has to be accepted by the other party. The offer has to be accepted as it was made; in case the in acceptance, the terms of the contracts are modified, then it is treated as a counter offer and not an acceptance. The acceptance has to be clearly communicated to the other party, and a mere silence cannot be treated as an acceptance. In the case of Felthouse v Bindley (1862)[5], the uncle has officered to purchase the home from his nephew and he stated that if he heard nothing from the nephew, he would consider the home as his. In this case, the court held that the acceptance was never communicated from the nephew, and mere silence cannot be treated as acceptance. So, a simple mental decision does not amount to acceptance[6]. Consideration is a crucial element of any contract, and without a consideration, a contract is void[7]. Two of these, i.e., an offer and an acceptance are crucial elements of the contract. An offer has to be made by one party, which then has to be accepted, as was made, by the other party. A general rule is present regarding the acceptance that only when the acceptance is communicated and such communication is received by the other party, then it has to be deemed as acceptance[11]. But an exception to this rule is the postal rules. When the acceptance is given regarding an offer and such is communicated through the post, then the date of acceptance is taken as the date on which the acceptance was posted[12]. These rules apply only in such cases where the post is acknowledged as the means of acceptance. And, whether or not the other party received such post, is irrelevant[13]. The rationale behind this is that the parties nominate the post office as their implied agent, so the receipt of acceptance by the post office has to be taken as the receipt by the other party. In one of the established cases of Tallerman Co Pty Ltd v Nathan's Merchandise (1957)[14], the judges were of the view that the acceptance by post would not be justified; unless and until the offering party has grounds to believe that the offer can be accepted by use of postal means[15]. In another case of Byrne v Van Tienhoven (1880)[16], the judge was of the view that the post office acts as an agent of the person posting the acceptance; and that the delivery made to the post office has to be taken as the delivery made to the other party[17]. Further, in case where a revocation of an offer has to be made, where the offer was made in postal form, then the revocation would only be effective, if it was received by the other party before they post the acceptance letter[18]. In the given case, the offer was made by Welwisha to Dowell through a telegram regarding the appointment as the senior accountant for the firm. It was further stated in the telegram that the formal letter of appointment was in the mail. And when Dowell received this communication, he posted his acceptance letter to the offer of the committee. So, a valid offer was made and the acceptance was validly communicated. Applying the case of Tallerman Co Pty Ltd v Nathan's Merchandise here, there was presence of clear grounds to believe that the offer could be accepted by use of postal means, as the means of post was used for making the offer. Moreover, applying the case of Byrne v Van Tienhoven, the post office was the agent of Welwisha while making the offer and Dowell while accepting the offer, and so the date of posting of acceptance would be deemed to be the date of acceptance by Dowell. After the letter was posted by Dowell, the committee met again and decided against appointment of Dowell. But this was never communicated to Dowell. Moreover, the revocation of an offer has to be sent before the acceptance is received on an offer. Consideration is the next element, which is deemed to be present in the letter of appointment. The parties had the intention to create a legally binding contract, as Welwisha sent an offer to form such relations, which was duly accepted by Dowell. Both the parties had to contractual capacity and the terms of the contract were also clear. Steve Rainwater 10-19-98 Mrs. Maynard English 1A The Advertisement "Wear it and be Happy," What is behind the words of advertisement? Besides how many different ads tell us the same thing, "buy, buy, buy." It seems like today, that all ads are summing up, that if you use their product, then your life will be better. Ads are supposed to attract the reader's eyes, just like this advertisement caught my eye with the quote. In the Clinique "Happy" ad, their quote is "wear it and be happy," but how can a perfume make you happy. Sure it may smell good and get you a compliment or two, but it is not going to make your life any easier or take away any of that non-wanted stress. So what is in an advertisement? This advertisement is trying to sell a product to a perfume buyer. At the same time, it's telling you something that it is completely incapable of doing, which is making you happy. It is working and this is what an advertisement is supposed do, sell. This advertisement, as I said in the paragraph above, caught my attention with their quote. The quote is about being happy and forces you to glance at the picture on the ad verse the bottle that they are trying to sell, which will probably be a one hundred-pound, beautiful model who is happy because she has everything that is out of the usual. On this advertisement they have this beautiful model with a big beautiful smile being kissed by this handsome man. It implies that if you wear this perfume then you will be just as happy as this woman on the cover does and possibly have good looking guys just like her. Well this is why I find advertisements somewhat ridiculous. When young girls look through these magazines and see these ads, it begins to influence them for what they are supposed to look like and be like. As these girls grow up, they will become more and more depressed because they won't have those size zero waists, those big fake breasts, or that perfect complexion. Instead the y will be bulimic, or possibly anorexic just so they can look and feel like these models do. What is an advertisement? Is it a picture of the product by itself in a single colored back round? Or could it be a picture of the product in use? Well the majority of advertisements today are not of the advertisement itself. It is normally of models and or roll models in a picture with the product showing that they use it, so it would be "cool" for you to also. Here is a product that must do something or else people won't buy it. For instance, this ad is of perfume and it does something, it smells. So to spice up the ad, they through in a girl being kissed by a guy who seems to be in glee. The product is not in the picture but it is on the side of the page next to the name. The girl just bought this perfume and because it smells good, she's happy and is falling in love. I believe this is what the advertiser wants people to think when buying his product, and why blame him, he's out there just like every other business man for only one reason, to make money. Advertisements can be good and bad in two ways. They can show the product off without being stereotypical, or they can show the perfect model doing something in the ad without really advertising it. This advertisement in particular gets me thinking to where really you don't need a model. If a product, such as perfume, is going to sell, it's going to sell due to it's reputation of having a good smell and not what kind of models you have advertising it. In conclusion, I choose this ad because I feel that there isn't a perfume on the market that can change a person's personality. If someone is going to be happy, then it's going to be because something or someone makes them happy by an act of kindness and not a smell.

At times, it is near-worshipped as a sign of sexuality, or as a sign of nourishment. Other times it is secured down, sometimes a sign of the inferiority of women or, conversely, as a sign of women's liberation and their equality to men. Whether it is intentional or subconscious, how the breast is viewed throughout history is a direct reflection of the views of the time. Legends about the breast have appeared in a variety of cultures. Greek, Indian, and Native American myth all contain stories which involve biting a breast. For example, Hercules was said to have gotten his extra-human strength from biting the breast of Hera as an infant. This and other such stories can be symbolic of an attack on Mother Nature or the earth goddess, and of man's ability to overcome her (Latteier 146). She was said to have appeared to Saint Barnard when he was praying and offered him a stream of her breast milk to drink from (46). A fourth cen tury prostitute was said to have been spared the death penalty by baring her breasts to the judges, who were so impressed by their beauty that they acquitted her (20). Minoan society on the island of Crete honored the breast. Women's clothing was designed to let the breasts show through. Women were placed in high social positions and power. Their breasts stood for material wealth, political power, and sacredness. The Minoans are given credit as the first people to use a corset. They wore bodices that laced below the bust, lifting and exposing the breasts (Winston). Priestesses known as snake goddesses were notorious for large breasts and snakes that coiled around their arm, both symbols of their power, potency mixed with sustenance (Yalom 15). Classic Greek society praised masculinity and repressed femininity. Women were encouraged to stay at home and they few little rights. Only the Hetaerae, a special upper class of women, were able to participate in social activities of men. The apodemos, a linen article worn by the Hetaerae, was considered to be the first brassiere (Silverman). It, however, usually flattened the breasts instead of accentuating them, reflecting the anti-feminine views of the time. With the rise of Christianity, the breasts and the flesh in general were discouraged from being exposed. The stomach was considered to be more of an important center of female sexuality, with rounded bellies being more attractive (Broby-Johansen 131). This was modeled after the Virgin Mary whose round belly contained the savior (Yalom 40). It wasn't until the fourteenth century and the Renaissance that this began to change. Explosive creativity and art occurred despite great famine and disease. As people became more frivolous, clothing became more revealing, and the neckline lowered to show cleavage (Latteire 31). The Spaniards had already managed to conquer the Indians of Mexico in the year 1519 under the leadership of Hernan Cortes. 3 The Incas though had no information concerning th e conquest of the Indians. The Inca people only realized that the white man was around in the years between 1523 to 1525. There was an attack by the Spaniards accompanied by the Indians of central Mexico and under the leadership of Alejo Garcia, a Spaniard, on the Inca at Gran Chaco. This helped in creating awareness among the Inca of the white man’s presence.4 In the year 1527, an outbreak of small pox affected the people of the empire leaving very devastating effects on the community. The Inca’s leader known as Huayna Capac passed away in the same year leaving a very large kingdom that encountered many wrangles on his progression. The leader had 500 boys and two of them seemed the favorites to succeed their father. They were Huascar and Atahualpa who resided in Cusco.5 This culminated in the outbreak of a civil unrest that lasted for a period of five years due to the power struggles between the brothers. The war was fought between two factions each being led by eithe r of the step brothers. Atahualpa won the war but his victory did not last long enough. This is because after two weeks the Spaniard Pizzarro arrived for his second trip to the region accompanied by one hundred and seventy seven men. Among these men only sixty seven of them were soldiers and they arrived in the year 1532 at Tumbes.6 The Inca leadership under Atahualpa had precise information concerning the whereabouts of the Spaniards.7 They however made faulty interpretations of the details since they were told that the white’s guns were only thunderbolts which could fire twice. Their soldiers were also told to that the whites man horses were not appropriate at night. 8 They claimed that the horse and the man were the same thing and the survival of one depended on the other. This implied that if one of them fell, the other was completely useless. The Inca people were also led into believing that the Spanish swords would do no harm to them. The perpetrators of this propaganda claimed that their swords were just as inefficient like a woman’s plank used for weaving purposes. I arrange many work for them, just left me some easy one. This was the first time I did not fair things for my teammates. Through the different media tools, I found the information and I finished my work before council arrangement. I was so happy and proud because I finished the work, but unfortunately, the result is not good. When my senior check my PPT he got a cry, he was very disappoint for our work, because I ignored many attentions he told to me, and I not told my team. It was t he last day, and he help us to correct our mistake in a hurry night. From this things, I start to get a change, tell myself to do things seriously, if I perfunctorily to finish, it is waste others times and myself times. What have you learnt about yourself thorough these experiences? Everyday we can get different experiences and from these experiences we can learn several of knowledge and it makes us growth. Through this event, I learned a lot and everything not just like what I think going. For myself by the thing, I recognize that I got some problem in my working pattern. The basic I dont have a good hearing behavior to take care the attention problem, it will cause a bad result. A good hearing is respect to other, and it will let opposite know you are well bred. With in the student council and work as a monitor I find time is hard to control and it pass very fast. To get a good time management is very important. Everyone no matter busy or lazy just only have 24hours a day, or 1440minutes. No matter how to use it, it will run away from us. During I work in the student council, I found it hard to use time with my personal entertainment. If I want after work get a play, it will influence the next day study. I understand a good time management is very important. I use a paper to calculate my spend time in a day and know which parts I worse the time. I get a schedule to do good arrangement of my time, I put study first, then use the free time like time before lunch and after class time to deal with the council work and coordinators work. Then the left night time I can share with my friends for entertainment or get a over time for student council, with this arrangement, I not lose any friends and get a good work in my class and student council. The other things I learn are it is important to use your team to finish the work. Teamwork is very important. One persons power cannot bigger than the group. It is important to know each others advantage and disadvantage, and then do an appropriate arrangement. In the student council, I find no matter do what things there always get a meeting. The meetings talk always makes a thing more depth to consider. If just let me to do it, I think my ignorance and arrogant will make me fail. With the work, I find one important weak. I need to develop my leadership. Stress management skill is one of the important skills of the leadership. Stress management required to maintain control and stability. To maintain a team success, the leader must be calm and various consider. For myself, I always feel lose if the work heavier than I can afford when I am a team leader. It also called lack-confidence. With to development this skill, I start to learn the SMART strategy. How have you developed your skills during the practice of management skills module? The practice of management skills is not like other subjects only have theory and calculation, it showed us something we need and can used in our life and study. Our lecturer provides the chance to have us improve our management skills systemic for several weeks. Through the study, I recognize different parts like importance of active listening and giving verbal feedback, time management, teamwork and good presentations and make a C.V. are real useful for my life. During the session active listening, I know a guy who dont listen others and later he got problem. And this story vividly told me the importance to understand others speaking. It has a direct influence to me. Through I laugh the guy in video I recognize I also do the same mistake. I find it is important to change the bad habit. A good listener should listen and responding the other by observes the other persons behavior and body language. And we need to give respect to the speaker no matter what he says good or not, and then we can get good communication with each other. Another advantage is managing time helps us to stay motivated while we avoid procrastination. A good start from how you arrange your time, the time management is really a important session for me to learn. During the teamwork study, class separate as several parts and choose one leadership to lead to use creativity to match. The different person works in the team help me understand how teamworks important and suitable use it will have a good result. During the good presentations, I learn how to make a good presentation. To do a good effective presentation, firstly need to formulate strategy for specific audience, secondly to develop a clear structure, thirdly, support the points with evidence. Then combine the ideas with an enhancing presentation style. To do better, you must good preparation and practice, practice and practice. A good presentation is very useful in my life, obviously, it is a useful session in my study. During make a C.V. I really got a clear understand about how to write a C.V. in before through I want write a C.V., I dont know the form to write .with the session learning, I get a correct thought to write my C.V. a good C.V. should not be long, it need short and enough, can exhibited your feature. To understand this is very important and avoid fail in the working way. Through our textbook not heavy and every session is simple, and not many lectures for PMS, I think I got a good unstinting about it, every lesson is marrow and after class I can find what I doing is not enough and wrong, it help me get a good check for myself. When I want to measure my progress,, I will ask myself the question such as when can finish ,how to accomplish . Give me a target time, and experience the exhilaration of achievement to reach my goal. Attainable When I identify the goal is most important, I try to figure out way I can make it come true. I try to develop my skills, abilities and attitudes to get it. Realistic The goal must represent an objective toward which I can work and willing to work. Try to keep myself get a good conditions. Some of hard work I can finish because I get the exhilaration which I love it and can do it simple Timely It is a goal should be grounded within a time schedule. If with no time schedule, there is no sense of urgency. A good timely will help you set your unconscious mind into motion to begin working on the goal. 55 Langdon and Vittoria exploded onto the courtyard outside the Secret Archives. The fresh air felt like a drug as it flowed into Langdon's lungs. The purple spots in his vision quickly faded. The guilt, however, did not. He had just been accomplice to stealing a priceless relic from the world's most private vault. The camerlegno had said, I am giving you my trust. â€Å"Hurry,† Vittoria said, still holding the folio in her hand and striding at a half-jog across Via Borgia in the direction of Olivetti's office. â€Å"If any water gets on that papyrus – â€Å" â€Å"Calm down. When we decipher this thing, we can return their sacred Folio 5.† Langdon accelerated to keep up. Beyond feeling like a criminal, he was still dazed over the document's spellbinding implications. John Milton was an Illuminatus. He composed the poem for Galileo to publish in Folio 5†¦ far from the eyes of the Vatican. As they left the courtyard, Vittoria held out the folio for Langdon. â€Å"You think you can decipher this thing? Or did we just kill all those brain cells for kicks?† Langdon took the document carefully in his hands. Without hesitation he slipped it into one of the breast pockets of his tweed jacket, out of the sunlight and dangers of moisture. â€Å"I deciphered it already.† Vittoria stopped short. â€Å"You what?† Langdon kept moving. The three sharpshooters carried laser-sighted rifles. Sitting in the passenger seat of the lead car, Olivetti turned backward toward Langdon and Vittoria. His eyes were filled with rage. â€Å"You assured me a sound explanation, and this is what I get?† Langdon felt cramped in the small car. â€Å"I understand your – â€Å" â€Å"No, you don't understand!† Olivetti never raised his voice, but his intensity tripled. â€Å"I have just removed a dozen of my best men from Vatican City on the eve of conclave. And I have done this to stake out the Pantheon based on the testimony of some American I have never met who has just interpreted a four-hundred-year-old poem. I have also just left the search for this antimatter weapon in the hands of secondary officers.† Langdon resisted the urge to pull Folio 5 from his pocket and wave it in Olivetti's face. â€Å"All I know is that the information we found refers to Raphael's tomb, and Raphael's tomb is inside the Pantheon.† The officer behind the wheel nodded. â€Å"He's right, commander. My wife and I – â€Å" â€Å"Drive,† Olivetti snapped. He turned back to Langdon. â€Å"How could a killer accomplish an assassination in such a crowded place and escape unseen?† â€Å"I don't know,† Langdon said. â€Å"But the Illuminati are obviously highly resourceful. They've broken into both CERN and Vatican City. It's only by luck that we know where the first kill zone is. The Pantheon is your one chance to catch this guy.† â€Å"More contradictions,† Olivetti said. â€Å"One chance? I thought you said there was some sort of pathway. A series of markers. If the Pantheon is the right spot, we can follow the pathway to the other markers. That is not the case. Because I am abandoning critical duties by being here, and because I have found very little that makes sense in this theory of yours about virgin sacrifices and ancient poetry, I cannot in good conscience continue. I am recalling this mission immediately.† He pulled out his walkie-talkie and clicked it on. Vittoria reached across the seat and grabbed his arm. â€Å"You can't!† Olivetti slammed down the walkie-talkie and fixed her with a red-hot stare. â€Å"Have you been to the Pantheon, Ms. Vetra?† â€Å"No, but I – â€Å" â€Å"Let me tell you something about it. The Pantheon is a single room. A circular cell made of stone and cement. It has one entrance. No windows. One narrow entrance. That entrance is flanked at all times by no less than four armed Roman policemen who protect this shrine from art defacers, anti-Christian terrorists, and gypsy tourist scams.† â€Å"Your point?† she said coolly. â€Å"My point?† Olivetti's knuckles gripped the seat. â€Å"My point is that what you have just told me is going to happen is utterly impossible! Can you give me one plausible scenario of how someone could kill a cardinal inside the Pantheon? How does one even get a hostage past the guards into the Pantheon in the first place? Much less actually kill him and get away?† Olivetti leaned over the seat, his coffee breath now in Langdon's face. â€Å"How, Mr. Langdon? The killer flies over in a helicopter and drops a screaming, branded cardinal down through the hole in the roof. The cardinal hits the marble floor and dies.† Everyone in the car turned and stared at Vittoria. Langdon didn't know what to think. You've got one sick imagination, lady, but you are quick. He pulled back the sleeve of his denim shirt to reveal a black chronograph military watch. â€Å"Seven-forty, commander. We'll need time to get in position.† Olivetti nodded vaguely but said nothing for many moments. He ran a finger back and forth across the dash, making a line in the dust. He studied Langdon in the side-view mirror, and Langdon felt himself being measured and weighed. Finally Olivetti turned back to the guard. There was reluctance in his voice. â€Å"I'll want separate approaches. Cars to Piazza della Rotunda, Via delgi Orfani, Piazza Sant'Ignacio, and Sant'Eustachio. No closer than two blocks. His clothing was folded on the chair beside the bed. Outside he could hear a nurse making the rounds. He lay there a long minute listening. Then, as quietly as possible, he pulled himself to the edge of the bed and retrieved his clothing. Struggling with his dead legs, he dressed himself. Then he dragged his body onto his wheelchair. Muffling a cough, he wheeled himself to the door. He moved manually, careful not to engage the motor. When he arrived at the door he peered out. The hall was empty. Silently, Maximilian Kohler slipped out of the infirmary.

Explication on a poem by Blanche Farley Essay

The human mind is in a constant state of flux. More so, a woman’s. Blanche Farley’s The Lover not Taken, beautifully captures the vacillating moods of a woman in and out love, and lends a very daring outrageous image of a woman’s mind. ‘The lover not taken’, in the life of the woman in Farley’s poem would be the significant choice made in a woman’s life – one that decides her character, her destiny. In this, it is as significant as ‘The Road not Taken’. The poem is a beautiful play of comparison and contrast of thought and feeling, of idealism versus realism, the heart and the mind. All alone, Farley’s Madame Bovary waits in time, left to herself. The woman, already bound and claimed in marriage, caught in turmoil, stands pondering at the crossroads, on the verge of giving in to the charms of her new-found suave lover’s lovely hair and smile Unhappy in a marriage, a woman’s heart is unchained, still seeking love. Having found it, the temptation to infidelity looms large. Yet the sensitive niche, in which a woman places herself, prevents her from giving herself freely away to her feelings. Her hating to face the sensitive situation, wishing not to displease her husband nor her lover, yet poignantly wanting to have the cake and eat it, – the vagaries of a woman are picturesquely portrayed. Mulling and wanting, weighing the outcomes of each decision, it is not until the last two lines of the poem, that the mood of the protagonist is actually decided. It appears as if she were her own judge, laying before herself the facts and reasons over which of the two men she would choose and why, and how. Structurally, every line of the poem ends in a pause, a change of mood, a dilemma. The end of every line assumes the consequence of its own course. Are the smiles of her charming lover more endearing than solemn promises of her husband, which he wears in his wedding ring? Guilt-ridden, she does admit her husband is indeed true to her. Yet, what of her love? Awaiting a twist of destiny, expecting a ‘way leading on to a way’, she hopes to find happiness in her love. Hoping for her love to receive her some day, well knowing the grave consequences of adultery, she heaves a sigh of lament. The irresolute, hesitant nature of thought is reflected through the juxtaposition of words like ‘mulling’ and ‘wanting’. Her desire is more for, her lover’s ‘smile’ than her husband’s ‘claim’. She imagines if her blonde lover ‘dropped by some day’, she wonders in fear if her husband, having known about her affair, ‘would ever come back’. Her need to stay in a marriage is very strong, when she tries to think ahead in time, several years away, when she would be recounting her tale to someone, and rejoice at how loyal a wife she had remained. It is only the security of a marriage and a home, which can subconsciously provide her such a stable thought. How finally primordial instincts win over moral values is captured as a conclusion to the poem. Unable to give up either her marriage or love, the woman decides to play it safe, both in love and marriage. It is very ironical that the poem begins with the word ‘committed’. Is the woman really committed to the one who has a claim on her? The frail-minded woman torn between her lover and husband becomes ready to turn into an unconscionable adulteress towards the end of the poem! To reach home and call the lover marks the culmination of this complete turnabout. To enjoy both the comfort of home and the heart, is a secret she alone would know and unflinchingly cherish! Renewable Energy Is Not the Answer Renewable Energy is defined as: a renewable natural resource or source of energy, such as water, wind, or solar power (Oxford English Dictionary). There are those that believe that our nation should abandon the use of fossil fuels such as oil, natural gas, and coal, and switch to renewable energy sources. Although the change could yield many benefits, I believe that renewable energy is a not viable alternative for our nation’s energy future because it would create an unfavorable environmental impact, it is not as reliable, and it would be too costly. Converting to renewable energy sources would have a devastating environmental impact. In addition to solar panels, wind turbines and hydroelectric dams would make up the largest portion of renewable energy generation. Wind farms create hazards in their areas of operation. They consume up to 200 times as much land as gas-fired power plants (Langwith). If 25 percent of our nation’s energy ca me from wind, the turbines would kill more than a million birds each year (Langwith). Experts have been unable to find a solution to this problem. Hydroelectric dams are harmful to the habitats of many fish. For example, the Bonneville Power Administration has an expensive program of capturing fish and moving them around its Columbia River dams.
